Terms of Service

Welcome to AICraft. By accessing or using our API services, website, and related tools (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms. AICraft reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or service announcement.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your API keys and for all activities under your account. You must notify AICraft immediately of any unauthorized use. API keys shown only once at creation; AICraft stores only cryptographic hashes and cannot recover lost keys.

3. Pricing, Payments, and Subscriptions

Subscription Plans. Subscription fees are billed monthly in advance. Included token allocations reset each billing cycle; unused tokens do not roll over. International model usage is billed separately at published pay-per-use rates plus applicable margin. Overage beyond included tokens is charged at pay-per-use rates.

Pay-Per-Use. Non-subscription usage is billed at published per-token rates. Prices are listed in USD on our pricing page. AICraft reserves the right to adjust pricing with 30 days' notice.

Payment Methods. We accept PayPal, credit/debit cards, and wire transfer (Enterprise plans). All fees are exclusive of applicable taxes. You are responsible for any sales, use, VAT, or similar taxes.

Currency. International site (aicraftapi.com): USD. Domestic site (cn.aicraftapi.com): RMB. Exchange rates for cross-currency payments follow the rate at time of transaction.

4. Service Level Agreement (SLA)

Availability Commitment. AICraft commits to 99% monthly service availability for paid subscription plans. Availability is calculated as: 1 − (failed requests / total requests) × 100%. "Failed request" means a request that returns a 5xx error due to AICraft's systems, excluding failures caused by invalid input, quota exhaustion, or upstream provider outages.

Compensation. If monthly availability falls below 99% but remains at or above 95%, affected customers are entitled to service credit equal to 10% of that month's subscription fee. If availability falls below 95%, the service credit increases to 20% of that month's subscription fee. Credits are applied to the next billing cycle. To claim, submit a request via email to support@aicraftapi.com within 30 days of the affected month. Service credits are the sole and exclusive remedy for availability failures.

Exclusions. SLA does not apply to: (a) Free plan accounts; (b) failures caused by upstream model providers; (c) scheduled maintenance (announced 24+ hours in advance); (d) force majeure events; (e) customer-caused failures including invalid API usage, quota exhaustion, or account suspension for violation of these Terms.

5. Acceptable Use

You agree not to use the Service for: (a) any illegal activity or violation of applicable laws; (b) generating content that is fraudulent, defamatory, harassing, or invasive of privacy; (c) developing weapons, surveillance, or military applications; (d) any activity that interferes with or disrupts the Service; (e) unauthorized access, scraping, or reverse engineering. AICRAFT RESERVES THE RIGHT TO SUSPEND OR TERMINATE ACCOUNTS THAT VIOLATE THESE TERMS WITHOUT PRIOR NOTICE. No refund will be provided for accounts terminated due to Acceptable Use violations.

6. Third-Party Model Providers

AICraft aggregates AI models from third-party providers including but not limited to cloud service providers and model developers. Model availability, performance, and pricing are subject to upstream provider conditions. AICRAFT DOES NOT GUARANTEE UNINTERRUPTED AVAILABILITY OF ANY SPECIFIC MODEL. International models may experience additional latency or intermittent unavailability due to cross-border network conditions. AICraft shall not be liable for service interruptions caused by upstream provider outages, policy changes, or regulatory actions. Where AICraft receives service credits or compensation from an upstream provider for an outage, AICraft will pass through a proportionate share to affected customers.

7. Data Privacy and Compliance

AICraft processes data in accordance with our Privacy Policy and applicable data protection laws. By using the Service, you represent that you have obtained all necessary consents for data processing. AICraft acts as a data processor for customer-submitted content. For details on data handling by user jurisdiction (PIPL, GDPR, LGPD, CCPA), refer to our Privacy Policy. Chinese domestic users (+86 registered) are subject to content moderation as required by PRC law. International users are processed under GDPR/PDPO standards with no content moderation.

8. Limitation of Liability

Disclaimer. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AICRAFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AICRAFT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED OUTPUTS MAY CONTAIN INACCURACIES; YOU ARE SOLELY RESPONSIBLE FOR VERIFYING OUTPUTS BEFORE USE.

Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AICRAFT'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE FEES PAID BY YOU TO AICRAFT IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Consequential Damages. IN NO EVENT SHALL AICRAFT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Upstream Limitation. AICraft's liability for failures attributable to third-party model providers is limited to the compensation AICraft actually receives from such providers for the same incident.

9. Refund Policy

Monthly Subscriptions. You may cancel at any time. Cancellation takes effect at the end of the current billing cycle. No partial-month refunds are provided for used periods. Prepaid months are non-refundable.

Annual Subscriptions. Annual plans may be cancelled within the first 30 days for a full refund, minus the value of tokens consumed at pay-per-use rates. After 30 days, the remaining period is refunded as service credits only, calculated as: (remaining months / 12) × annual fee, minus any discounts applied.

Pay-Per-Use. Pre-paid credits are non-refundable. Unused credits remain in your account and do not expire for 12 months from date of purchase.

Service Credit. SLA compensation and promotional credits are not redeemable for cash and are non-transferable.

10. Termination

Either party may terminate the agreement at any time. AICraft may suspend or terminate accounts for violation of these Terms with or without notice. Upon termination, your right to access the Service ceases immediately. Data retention after termination follows our Privacy Policy. Provisions regarding limitation of liability, indemnification, and payment obligations survive termination.
